InnoQuests LLC respects the privacy of our users. This Privacy Policy constitutes a legal agreement between one or more person(s) or an entity/entities (“player(s),” “user(s),” “you/your/they/their”) accessing or using our Services and InnoQuests LLC (“us,” “we/our,” “InnoQuests LLC”). Throughout the privacy policy, we utilize a combination of italics and underlining to identify words that are defined in our Terms and Conditions of Use (“our Terms” or “the Terms”). The designation appears only the first time a word is employed, but definitions should be applied consistently throughout the Privacy Policy.
The InnoQuests mobile app (“the app,” “our app,” “the application,” “our application”) is a product and affiliated service of InnoQuests LLC. The app offers users the ability to purchase tickets for – and subsequently access and play – interactive games based in real-world locations. A single story or game within the app is referred to as an “InnoQuest” or “game,” using the plural “InnoQuests” or “games.” Collectively, we refer to the InnoQuests mobile application, any communications between us and you, any of our social media profiles, and the InnoQuests LLC website located at http://www.innoquests.com as our “Services,” unless otherwise stated. This Privacy Policy governs your use of and access to those Services, including our Content.
Throughout this policy, we may reference third-party data collection. Third-party data collection pertains to information that is accessed, collected, stored, used, tracked, transmitted, and/or disposed of by one of our trusted third-party providers. InnoQuests LLC makes every effort to disclose the types of information that may be accessed, collected, stored, used, tracked, transmitted, and/or disposed of by third-party providers. However, you are reminded that InnoQuests LLC is not responsible for third-party providers’ access, collection, storage, usage, tracking, transmission, and/or disposal of any data. We provide links to third-party providers’ privacy policies throughout our own privacy policy and remind you to consult them before agreeing to our Privacy Policy.
Please read the Privacy Policy carefully, as it outlines how your data are accessed, collected, stored, managed, disclosed, and disposed of over the course of your use of or access to our Services. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, YOU MAY NOT ACCESS OR USE OUR SERVICES.
We may collect and use various forms of information and data from you throughout your access to and/or use of our Services. This information is collected in various ways (e.g., voluntarily provided, based on service use). This section reviews the information that we collect.
The following types of data are those that may be collected through your use of, interaction with, and/or access to our app: contact information (email, name), financial information (payment information), user content (gameplay content), identifiers (user ID, device ID, purchase history), usage data (product interaction), and diagnostics (crash data). All other types of data discussed in our Privacy Policy are optionally disclosed herein. They may represent data that are voluntarily provided by you, are provided or accessed outside of the InnoQuests mobile app (e.g., via social media or our website), and/or represent data that do not leave the user’s device.
a. Contact Information. When you establish an account with InnoQuests LLC, you share the following information:
· E-mail address. You may also provide your e-mail address through other means (e.g., making a customer support request, completing a contact form, voluntarily providing this information).
Your email address is used:
o To provide app functionality. For example, your email address is used to verify your account and authenticate you in the app.
o To communicate with you about general business purposes (e.g., changes to our Privacy Policy or Terms and Conditions of Use)
o To send you communications pertaining to your purchases
o To offer you advertisements or marketing information for our Services (This use of your email is optional).
When you establish an account with InnoQuests LLC, or communicate with us in any other form (e.g., via social media, digital, written, oral or other communication), you may also optionally share:
· Name (First name, Last name)
Your name may be used:
o To personalize your account page in our app
o To personalize and include your name in marketing/advertising messages (if you have agreed to receive promotional e-mails from us)
o To perform customer support
Data Collected from Logging-In/Accessing our Services via Third-Party Providers. If you choose to access our Services via a Third-Party provider, such as Google, Apple, and/or Facebook, we will request and access personal information from those providers. Specifically, we request information on your ID, name, and e-mail in order to establish your account with us. You must provide consent through the third-party provider for us to access your personal information. You are encouraged to review any relevant privacy policies from Google, Apple, and/or Facebook. You should also adjust permissions on those accounts to meet your personal privacy preferences. If you do not want us to share information with third-party providers or to access information from third-party providers, you should NOT log-in with a third-party provider. Instead, you should establish a unique account within our app.
b. Financial Information. When you enter a payment for our Services, you may provide the following information:
· Payment Information: Payment information includes all information affiliated with the purchase process, such as your credit card number, associated expiration date, security code, and zip code. This information is all requested, collected, stored, and processed via Square. You should review Square’s privacy policy, as they are responsible for processing your payment.
Financial information is used:
o To provide app functionality. For example, financial information is used to facilitate processing of your payments, provide refunds as necessary, and/or to conduct any other financial transactions pertaining to your use of our Services.
c. User Content. Through your interactions with us and our Services, you may provide additional user content (i.e., “your Content”).
· Gameplay Content. Gameplay content includes any content that you generate while using our Services, such as game reviews, player(s)’ responses/answers to games, and/or player(s)’ scores.
We use gameplay content:
o To provide app functionality, such as by delivering a new puzzle in response to a user’s answer
Outside of our app, we collect additional User Content. The User Content described below is not referenced in the InnoQuests listings on mobile app stores as it does not originate within the app. However, we provide a description of it here, so that you can better understand its use.
· Customer Support. Customer support content includes data that you generate in communication with us via e-mail, social media, or any other form of digital, written, or oral communication.
· Browsing History. Our app does not track content that you have viewed outside of the app. However, when you visit our website located at http://www.innoquests.com, we collect information such as your clicks, internal links, pages visited, pages visited prior to our website, and other details. In order to fulfill these purposes, we may use first or third-party cookies, web beacons, or similar technologies. More detail is provided in our Cookie Policy.
· Other User Content. When using our Services, you may also voluntarily provide us with information such as ideas, feedback, comments, and/or suggestions. Additional methods of voluntarily providing us with personal data include, but are not limited to, your interactions with us via social media, online reviews, verbal, written, or digital channels of communication, and/or your responses to surveys, sweepstakes, contests, and/or giveaways.
d. Identifiers. We may collect information on your User ID, Device ID, and your history of purchases made within our app.
· User ID. Your User ID includes your screen name, player name, and/or other identifying customer number used for identification of your account.
We use your User ID for the following purposes:
· To provide app functionality.
· To conduct analytics, such as by examining patterns of interaction on the app.
· Device ID. A device ID is a device-level identification number.
We use your device ID:
· To provide app functionality. For example, to improve stability of the application.
· Purchase History. We track information on your purchase history. This includes such information as the account initiating the purchase, the number of tickets purchased, and relevant ticket information (e.g., used for multi-player access).
We use purchase information:
o To provide app functionality. For example, we must have a record of your purchase in order to examine refund or customer support requests. Your purchase history also includes information on additional player ticket(s) that have been purchased and may have been transferred to another device/player for use.
e. Usage Data. When you access our Services, our servers automatically collect information on your use of our Services.
· Product Interaction. We collect data on actions that are native to our app, including but not limited to length of game play, saved place in a game, number of players, teammates’ user names, points earned, use of hints, use of walkthroughs, errors, game performance, use patterns, and/or additional details pertaining to gameplay.
We use information on product interaction:
o To provide app functionality, such as by enabling multiplayer mode, transferring tickets between users, and/or delivering our Services
o To analyze your use of our Services (e.g., by evaluating number of hints and walkthroughs utilized, evaluating errors in responses provided), allowing us to make improvements to our services
f. Diagnostics. When you access our Services, we may collect information on our Services’ performance.
· Crash Data. We utilize crash logs to identify if/when our app experiences a crash.
If reported, crash data is used:
o For analytics purposes, allowing us to identify any bugs or errors in our Services.
g. Geolocation Information. We will request permission to access and track location-based information from your mobile device. We do this in order to help you locate games near you. This feature must also be activated in order to receive and solve clues in some of our games. Your preferences for allowing us to access geolocation information can be changed at any time within the settings native to your device. Please note that we access and use geolocation information while you are using the app and it is not transmitted off of your device in a way that allows us or any other third-party providers to access it for longer than required to deliver our Services. We do not track your geolocation information when the app is not open on your device.
h. Mobile Device Access. We may request permission and access to specific features of your mobile device prior to your participation in particular games. Such features may include your camera and/or motion/orientation-associated mobile features. Access to these and/or other noted features will allow us to deliver clues/puzzles specific to various InnoQuests. You will provide explicit permission to allow us to access such features for the specific purpose of delivering our Services. Your preferences for allowing us access to these features can be changed at any time within the settings native to your device. Please note that we only access such features while the app is in use; We do not access them when the app is not open on your device.
i. Technical Data (website/social media only). As you interact with our Services outside of our mobile app, we may collect information on the device and associated identifying information (e.g., IP address) utilized to access our Services. We examine factors such as platforms that lead a user to our website (e.g., search, webpage, email, social media), interactions with website content (e.g., forms, button clicks), and general geographic information as to where access occurred.
j. Derivative Data. We also may process your data in aggregate form and analyze it to examine usage statistics, patterns, and/or trends. These derivative data could be used for purposes such as (but not limited to) making recommendations (shared either internally to or externally from InnoQuests LLC), modifying our Services, promoting our Services, and/or for any other legitimate business purpose.
2. WHY WE COLLECT YOUR INFORMATION
In addition to outlining some of the more specific uses of your data provided above, it is very important that you understand why we collect your information. More generally, your information is used to:
· Create an account with us and provide you with access to our Services
· Manage your account (e.g., reset your password)
· Contact or communicate with you; this includes, but is not limited to, sharing our Terms and Conditions of Use and Privacy Policy, responding to your communication(s), initiating our own communication(s), and/or engaging in direct marketing/advertising
· Understand your use of our Services in order to make updates to improve the user experience and/or functionality of our Services; this includes analytics, market research, and any other business purpose
· Offer you promotions, contests, sweepstakes, and surveys
· Maintain our records accurately
· Facilitate processing of your payments, refunds, and/or any other financial transactions pertaining to your use of our Services
· Cooperate with requests from law enforcement, government, or other regulatory agencies, including responding to subpoena
· Initiate requests to law enforcement or legal counsel to assist with suspected or actual instances of fraud, theft, other criminal activity, and/or violations of our Privacy Policy or our Terms and Conditions of Use
· Resolve disputes pertaining to your access to, use of, or actions related to your interaction with InnoQuests LLC and/or our Services
· Perform any other business activities, as required
3. LEGAL BASIS FOR PROCESSING YOUR INFORMATION
Our collection, processing, storage, and release of your information, as noted in section 1 and section 2, is deemed necessary on the following legal basis, such as when:
· We are using your information to fulfill a contract (e.g., delivery of our Services) or to develop a contract (e.g., establishing an account)
· We are fulfilling a legitimate business interest (e.g., marketing/promotion, research/development, user experience) pursued directly by InnoQuests LLC or by a third-party on our behalf
· We are fulfilling a request from you and/or have received explicit permission to use your data in a given manner
· We are fulfilling a legal obligation
· We are protecting our rights and/or the rights of any other person(s), entity/entities, and their associated property/properties and/or possessions
4. HOW WE SHARE YOUR INFORMATION
We take extensive efforts to protect your privacy, but there are situations in which we may share your information with others. We only share as much information as is required to complete a task. Whenever possible, these data are provided in anonymized form. Third-party providers are required to protect your confidentiality to the same or greater extent as the protection provided by this agreement.
a. Public Information. You should understand that some of your information is visible to the public. This includes your Player Name, score(s) on any InnoQuest(s) played, and reviews. People will see your Player Name, team member(s)’ Player Name(s), and scores on the leaderboards associated with each InnoQuest. Should you choose to post a review, this information is also public.
b. Third-Parties. We work with third-parties who perform services, such as payment processing, on our behalf. Third-parties may also perform tasks such as e-mail delivery, hosting services, data analysis, marketing assistance, delivery of a competition, sweepstakes, survey, or contest, data storage, collection, or processing, consultation, maintenance, or any other legitimate business purpose relevant to InnoQuests LLC and/or our Services. Information you provide is disclosed to such parties only to the extent necessary to deliver associated services. Protection of your information in such situations is reviewed in section 5 of this policy.
As noted earlier, you should read the privacy policy from Square to understand the handling of your financial data, as Square serves as our third-party provider for facilitating purchases. As such, InnoQuests LLC retains no financial information. We are able to obtain information about your purchase, such as a user’s description and quantity of tickets or other items purchased, as well as information on whether tickets have been activated/used to initiate an InnoQuest.
c. Sale of our Business/Services. In the event that InnoQuests LLC chooses to sell, partner, merger, consolidate, or dispose of our business (e.g., in the event of bankruptcy), your data may be treated as an asset, resulting in a transfer of ownership of your data to one or more new entities. Those entities have the right to handle your data in accordance with their own privacy policy and associated terms.
d. Marketing Communications. As permitted by law, we may use your personal information to send you promotional offers, surveys, contests, sweepstakes, and/or newsletters pertaining to our Services. Please note that you may opt-out of advertising efforts at any time by emailing: support@innoquests.com or by selecting the ‘opt-out’ option in the main menu of the InnoQuests mobile app.
Unless otherwise noted in this agreement, when required by law, and/or with your explicit permission, we will not sell, distribute, or lease your personal information to unrelated third-parties.
e. Legal Compliance & Enforcement of Our Rights. In instances pertaining to protecting our legal rights, the legal rights of others, and/or at the request of law enforcement, we may share your information as permitted or required by any applicable law, rule, or regulation. In such instances, data collected – including your personal information – may be shared with law enforcement, government and regulatory agencies, and/or legal counsel. This may include companies or organizations such as credit reporting agencies and associated organizations that may help to protect against fraud. Sharing of your data in such instances may occur as a result of any of the following or due to any other legally necessary reason:
· To protect our rights and our Services
· To enforce our Terms and Conditions of Use
· To address relevant billing/financial issues
· To help protect against fraud
· To protect others’ rights and/or property
· To comply with a court order, subpoena, or other request from a government or regulatory agency
You are reminded that the above-noted uses may be carried out as a result of actual or anticipated legal proceedings or actual or suspected violations of any applicable rule, regulation, law, or policy.
f. Analytics. We use Google Analytics and Squarespace to obtain information on user interactions with our website and analyze the effectiveness of our website. By accessing our website, you consent to the use of tracking technologies, the collection of your data, and the use of your information by these vendors. You are encouraged to review the privacy policies of both Google Analytics and Squarespace. You should contact these companies directly with any questions about tracking tools and techniques encountered in the delivery of our website. You agree that by using our website you consent to any and all policies associated with these vendors. You are reminded that use of Google Analytics and cookies placed by Squarespace pertains only to our website; data collected via the InnoQuests mobile app are not handled by these third-party providers.
5. HOW WE SECURE YOUR INFORMATION
We are extremely cautious to employ the appropriate security measures to protect your information. For example, we store the majority of your information in masked form. You should be aware that any form of digital transmission of data is vulnerable to attacks, abuse, misuse, or interception by other unauthorized parties. Further detail on your assumption of risk is provided in our Terms and Conditions of Use. InnoQuests LLC maintains a security breach response plan that is informed by relevant rules, regulations, and/or policies that are pertinent to determining if a breach occurred and outlines relevant procedures for notifying consumers in the event that a notifiable breach were to occur.
The cookie policy applies to our Services accessed outside of the InnoQuests mobile app. In delivering our Services, we may work with third-party providers to fulfill any legitimate business purpose (e.g., hosting, maintenance, analysis, improvement of our Services). InnoQuests LLC and/or our third-party providers may use cookies, web beacons, pixel tags, or similar tracking technologies to fulfill these business purposes. Web beacons, pixel tags, and other technologies are transparent images and/or small files accessed while you examine our content. These help us to understand factors such as the number of people who access particular content or to assess the effectiveness of our Services. Cookies and associated technologies are small files or pieces of text that download to a device when you access our Services. You should be aware of the different types of cookies that we use:
· Functional & Required Cookies. These cookies are required by Squarespace, our website hosting platform, in order to securely deliver our website to you. You may review the list of functional and required cookies here. These cookies are used to ensure the security and functionality of our website.
· Analytics & Performance Cookies. When you accept the cookie banner on our website, you provide permission for us to utilize analytics and performance cookies. These cookies help us to assess site traffic, activity, and other data. You may review the list of analytics and performance cookies we use here. We may also employ additional cookies via Google Analytics.
You should understand that InnoQuests LLC makes every effort to contract with third-party providers who handle your data cautiously. However, we have no control over cookies, web beacons, pixel tags, and/or other tracking technologies that are placed by third-party service providers, including Squarespace. Placement of a third-party cookie could result in tracking on other services. InnoQuests LLC seeks to contract with responsible service providers who protect our client’s privacy, but cookies, web beacons, pixel tags, and/or other tracking technologies placed by any third-party provider are not within the domain of the InnoQuests LLC privacy policy.
If you have additional questions about the cookies utilized in association with our website, including how to view a list of cookies placed by Squarespace, our hosting platform, you are encouraged to read more information provided by Squarespace and Google Analytics.
Removing Cookies. You should be aware that you may alter your browser’s settings to remove or reject cookies. Generally, a browser will allow a user to reject all cookies or to make a decision about a cookie each time a website seeks to set or update a cookie. You should be aware that if you decline, reject, or refuse cookies, it may impact the functionality of our Services.
You may not decline web beacons. However, by setting your browser to decline all cookies or by individually declining cookies, you can prevent web beacons from tracking your activity. Again, such action may impact the functionality of our Services.
7. LIMITS TO OUR PRIVACY POLICY
In accessing and/or using our Services, you may encounter external links to other businesses or services that are not associated with us. You may also physically interact with businesses or services during an InnoQuest. Even if you visit such digital or physical entities in conjunction with your use of or access to our Services, we are not responsible for the content, privacy policies, or security policies of any other entity, nor are we responsible for how they disclose or use your information, including for solicitation purposes. InnoQuests LLC reminds you to consider third parties’ privacy policies and safety measures when sharing personal information. Should you have difficulties with a third-party pertaining to your personal information, you would need to contact that party directly.
As noted in our Terms and Conditions of Use, our Services are intended for individuals equal to or greater than 18 years of age. We do not knowingly solicit information from or market to children under the age of 18. If you become aware of any data we have collected from an individual under age 18, please contact us immediately at support@innoquests.com to ensure any information is promptly removed from our system.
Many browsers used on computers, mobile phones, and other associated technologies have a “Do Not Track” (DNT) option. By exercising this option, one may choose to opt-out of the tracking of their online behavior by various companies. We do not recognize, respond to, or honor DNT requests. The opt-out mechanisms available to you while using our Services are covered in sections 6 and 10 of this policy.
10. YOUR CONTROL OVER AND RIGHTS TO YOUR INFORMATION
By providing us with your information and/or accessing or using our Services, you are entering a legal agreement with InnoQuests LLC in which you agree to allow us to store, collect, process, use, and disclose your information as outlined in this policy. This protection extends to information that we receive from third-party providers.
You have rights to the personal/identified information that we collect. You may exercise those rights as follows:
· If, at any time, you believe the information that we hold is incorrect, incomplete, or misleading, you may contact us at support@innoquests.com to request an amendment to your information.
· If you have previously opted-in to our direct marketing efforts, you may choose to opt-out at any time. You may opt-out by electing this option via the ‘My Account’ menu in our app. You may also e-mail support@innoquests.com with your request.
· You may request that we delete or erase any personally identifiable information that we have stored about you. You may make this request by e-mailing support@innoquests.com. We assert that InnoQuests LLC will remove all of your data within 30 days of your written request.
· You may request deletion of your account via the main menu in our app. In so doing, you are requesting that we delete, erase, and/or destroy any personally identifiable information that we hold about your account. We assert that InnoQuests LLC will respond to and complete these requests within 30 days of receipt.
· You acknowledge that situations exist wherein InnoQuests LLC may retain some of your data, including personally identifiable information, for legal purposes, despite your request for account deletion.
We have the right to modify or amend our Privacy Policy at any time. In the event that a modification or amendment has occurred, you will notice a change to the “Updated and Effective” date noted at the top of this policy. Your continued use of our Services following a modification indicates that you accept and agree to our modified Privacy Policy. If you do not agree to our modified Privacy Policy, you must stop accessing our Services. We encourage you to review the Privacy Policy from time-to-time. We also ask you to affirm your agreement to the Privacy Policy each time you purchase ticket(s) for an InnoQuest.
